Terms of Service
Read this before using the Service. By creating an account, you agree to be bound by these terms. If you do not agree, do not use the Service.
1. Who we are
"OGIDIGA" (the "Service") is a shellcode packing and payload generation platform operated by [YOUR LEGAL ENTITY NAME], a company registered in [JURISDICTION] ("we," "us," "our").
2. What the Service does
The Service generates binary payload files from user-supplied shellcode. It provides cryptographic obfuscation, injection-method selection, and runtime-evasion configuration. The Service is intended exclusively for authorized security testing, including:
- Penetration testing performed under a signed engagement letter or statement of work
- Red team exercises authorized in writing by the target organization
- Security research on systems you own or have explicit permission to test
- Capture-the-flag competitions and authorized lab environments
3. What the Service does not do
The Service does not grant you any right or permission to test any system. You are solely responsible for obtaining the authorization required to use any payload generated by the Service on any target. We do not verify whether you have authorization, and we do not endorse any specific use.
4. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. You must not be located in, or a resident of, any country subject to comprehensive trade sanctions imposed by the United States, the European Union, the United Kingdom, or the United Nations. You must not be listed on any government restricted-party list, including but not limited to the U.S. Treasury Department's SDN List, the U.S. Commerce Department's Entity List, or any equivalent list maintained by any other jurisdiction.
5. Acceptable use
You agree not to use the Service to:
- Deploy any payload against any system without prior written authorization from the owner of that system
- Conduct offensive operations against critical infrastructure, healthcare providers, financial institutions, government networks, educational institutions, or any target that would constitute a criminal offense under applicable law
- Create, distribute, or facilitate ransomware, wipers, spyware intended for stalking or harassment, or any malware designed to cause destruction or extortion
- Target individuals for the purpose of harassment, stalking, intimate-image abuse, or non-consensual surveillance
- Violate any applicable export control law, including the U.S. International Traffic in Arms Regulations (ITAR), the U.S. Export Administration Regulations (EAR), or the EU Dual-Use Regulation
- Circumvent the Service's subscription, rate-limiting, or access-control mechanisms
- Reverse-engineer, resell, sublicense, or redistribute the Service or its output as a competing product
- Use the Service to build payloads for sale to third parties who have not independently agreed to these terms
6. Your responsibilities
You are solely responsible for: (a) the shellcode you upload; (b) the payloads you generate; (c) any system you deploy them against; (d) any damage, loss, or legal consequence arising from your use; (e) maintaining the security of your account credentials; (f) any activity that occurs through your account.
You warrant that you have, and will maintain throughout your use of the Service, all authorizations, licenses, and permissions necessary to engage in the activities for which you use the Service.
7. Subscriptions and payment
Access to the Service requires a paid subscription. Payment is accepted in cryptocurrency only. Subscription periods are prepaid and non-refundable except where required by applicable law. We may change pricing with 30 days' notice; existing paid periods are honored at the price in effect when the period was purchased.
We may suspend or terminate your subscription at any time for violation of these terms, without refund.
8. Termination and suspension
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that your use of the Service presents a risk to us, to third parties, or to the public interest. Grounds for termination include but are not limited to: violation of Section 5, receipt of a credible complaint of unauthorized use, receipt of a legal process from a government authority, or any indication that your account is being used for activity that is or may be unlawful.
We may also report activity to law enforcement, retain your account records and build logs, and cooperate with any investigation, without notice to you.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT ANY PAYLOAD GENERATED BY THE SERVICE WILL FUNCTION AS INTENDED ON ANY TARGET, OR THAT ANY PAYLOAD WILL EVADE ANY PARTICULAR DETECTION SYSTEM.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless [YOUR LEGAL ENTITY NAME], its officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Service or any payload you generate with it
- Your violation of these terms
- Your violation of any applicable law or the rights of any third party
- Any claim that your use of the Service caused damage to a third party
12. Monitoring and disclosure
We log every build request, including your account identity, IP address, seed value, and payload hash. We may disclose these logs to law enforcement, regulatory authorities, or in response to a valid legal process. We may also disclose them to a target organization that provides credible evidence it was affected by a payload you generated, where we determine disclosure is necessary or appropriate.
13. Export control compliance
The Service and any payloads it generates may be subject to export control laws. You agree to comply with all applicable export control laws and not to export, re-export, or transfer the Service or any payload in violation of any such law.
14. Changes to these terms
We may modify these terms at any time. Material changes will be posted on this page with a new effective date. Your continued use of the Service after a change constitutes acceptance of the modified terms.
15. Governing law and venue
These terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-law principles. Any dispute arising from or relating to these terms or the Service will be brought exclusively in the courts of [JURISDICTION], and you consent to personal jurisdiction there.
16. Class action waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION AGAINST US.
17. Severability
If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect.
